Anatolio Nzang Nguema, Attorney General of the Republic, noted that the investigation focuses on the possibility that Balthazar is infected with a sexually transmitted disease (STD) and that it may have been intentionally spread through his intimate relationships.
According to Nzang Nguema, the legislation of Equatorial Guinea does not penalize consensual sexual relations, as long as there is no complaint by those involved or evidence of a crime of integrity. However, if it is proven that Balthazar deliberately spread an infectious disease, he could face charges of tempting against public health.
If the Attorney General determines that Balthazar possesses a contagious disease and intentionally transmitted it, the official could be prosecuted. According to local laws, deliberately spreading infectious diseases is punishable by imprisonment, especially if it is carried out through sexual acts. This possible accusation adds to his current legal problems due to alleged cases of corruption.
